Refund and Cancellation Policy

This Refund and Cancellation Policy (this "Policy") describes the cancellation rights and refund terms that apply to the Telehealth Services delivered through findmydirectdoctor.com by OpenLoop Healthcare Partners, PC and its affiliated professional corporations (collectively, the "Healthcare Provider"). This Policy is incorporated into and forms part of the FindMyDirectDoctor
Terms of Service and should be read together with Sections 8, 13, and 23 of the Terms of Service.
This Policy applies only to the Telehealth Services. It does not apply to FindMyDirectDoctor's Paid Advertising Services for doctors, which are governed by Section 7 of the Terms of Service, or to any other product or service offered by FindMyDirectDoctor that is not delivered by the Healthcare Provider.
1. FindMyDirectDoctor's Role; Healthcare Provider as Merchant of Record.
FindMyDirectDoctor does not hold patient funds, does not process card payments, and does not store card data. Payment for the Telehealth Services is processed by the Healthcare Provider through its own merchant account and payment processor. The Healthcare Provider is the merchant of record for all Telehealth Services charges and is responsible for processing all cancellations, refunds, and payment disputes in accordance with this Policy. References below to "we," "our," "our medical provider," and "customer service" are to the Healthcare Provider in its capacity as the merchant of record and the clinical entity delivering the Subscription Services.
2. Subscription Services.
- Your membership in the subscription program ("Subscription Service"), including your ability to access the services, begins when you have completed the intake form at which time you will be charged for the first month of the Subscription Services.
- The Subscription Services include access to providers, medications where appropriate, and online support.
- Please note if you are disqualified by our medical provider for any medical reason you will receive a full refund.
- There is no guarantee of results or effectiveness due to your participation in the Subscription Services.
3. Cancellation Policy.
- You may cancel your Subscription Service at any time for any reason. To cancel your Subscription Services, please contact customer service and request a cancellation or through the process outlined in your online account (if applicable).
- To ensure a smooth process, we require your cancellation request to be received at least 72 hours prior to your billing date. If this notice date is not met, your subscription will be charged on the next billing date, and the cancellation will take effect on the subsequent billing date.
- After cancellation, you will continue to receive the Subscription Services through the end of your billing cycle.
- Please see our Refund Policy below to determine if you are eligible for a refund of your canceled Subscription Service.
4. Refund Policy.
- If your Subscription Service is cancelled due to disqualification by our medical provider, you will be issued a refund for the remainder of your Subscription Service charges following the disqualification.
- Other than cancellation due to medical disqualification, IN NO EVENT SHALL YOU BE ISSUED A REFUND UPON CANCELLATION OF THE SUBSCRIPTION SERVICES.
- Federal law generally prohibits the return of prescription medications to pharmacies for refund or reuse once they have been ordered to a patient in order to protect public health and safety. This policy ensures that all medications provided are handled and dispensed with utmost care and compliance. If approved, refunds will only be issued for your most recent billing cycle and will not be issued for past billing cycles.
- Damaged or Incorrect items: Please inspect your medication immediately upon receipt. If the medication appears to be damaged or incorrect, please contact customer service immediately.
- Damaged items: Damaged items may be replaced by the pharmacy upon receipt of evidence of damage.
- Incorrect items: Incorrect medications will be replaced by the pharmacy.
5. Subscription Services FAQs.
- What is included in my Subscription Services price?
- Your Subscription Services represents a single price for the subscription purchased. This may include consultations both live and via electronic form submissions and reviews with a Provider for medications that are fulfilled through a pharmacy or other health care services on which we collect payments, lab services, care support, 24/7 patient support line and other services to support your medical weight loss journey. Services, labs and medications covered with the single Subscription Service price may vary.
- What if my provider determines I am no longer eligible for the Subscription Services?
- If your Provider determines you are no longer eligible for the Subscription Services, your subscription will be canceled, and a refund may be issued. If you have questions or concerns about an eligibility-initiated cancellation, please contact our customer service at [email protected] or (855) 597-1248 (24 hours a day, 7 days a week), or through your member portal.
- Unless otherwise stated herein, FindMyDirectDoctor Terms and Conditions govern the Subscription Services Cancellation and Refund Policy.
6. How to Cancel or Request a Refund.
To cancel your Subscription Service or to request a refund under Section 4 above, contact the Healthcare Provider's patient support (referred to in this Policy as "customer service") through any of the following methods:
- Member portal: Log in to your member account and use the cancellation or refund-request function in the portal.
- Email: [email protected], including your full name and the email address associated with your account.
- Phone: (855) 597-1248 (Healthcare Provider patient support, available 24 hours a day, 7 days a week).
If you contact FindMyDirectDoctor first about a cancellation or refund request, your request will be routed to the Healthcare Provider for processing. The substantive response, including any cancellation effective date and any refund decision, is made by the Healthcare Provider in its capacity as the merchant of record and as the clinical entity responsible for the Telehealth Services.
7. Refund Processing.
Where a refund is issued under Section 4 above (medical disqualification, or, in the Healthcare Provider's discretion, the most recent billing cycle), the refund is issued by the Healthcare Provider to the original payment method used at the time of the charge. The time required for a refund to post to your account depends on your card issuer or payment provider and is outside the control of either the Healthcare Provider or FindMyDirectDoctor.
8. State-Law Cancellation Rights.
Residents of certain states have additional cancellation and refund rights under state automatic-renewal statutes, including but not limited to California Business and Professions Code section 17600 et seq., New York General Business Law section 527-a, the Illinois Automatic Contract Renewal Act, and Vermont's Automatic Renewal Law. Where state law provides a cancellation or refund right that is more favorable to you than the terms of this Policy, the applicable state-law right controls. Additional disclosures specific to your state of residence are provided at checkout where required by law, as further described in Section 23 of the Terms of Service.
9. Disputes and Chargebacks.
If you have a question or concern about a Telehealth Services charge, please first contact the Healthcare Provider's customer service using the methods described in Section 6. The Healthcare Provider is positioned to research the charge, confirm the underlying service or medication, and apply the cancellation and refund rules in this Policy. Initiating a chargeback with your bank or card issuer before contacting customer service may delay resolution.
If you initiate a chargeback or payment reversal with your bank or card issuer for a charge processed by the Healthcare Provider in connection with the Telehealth Services, you authorize FindMyDirectDoctor and the Healthcare Provider to respond to that chargeback with documentation of your account, your subscription, and any services rendered, in accordance with Section 13 of the Terms of Service.
10. Changes to This Policy.
FindMyDirectDoctor may modify, amend, replace, or suspend this Policy at any time, including to reflect updates to the Healthcare Provider's Subscription Services Cancellation and Refund Policy. When we make changes, we will post the updated Policy on the Website with a revised "Last Updated" date. Material changes will take effect at the start of a subsequent billing cycle, and continued use of the Telehealth Services after the effective date of a change constitutes acceptance of the change, subject to any contrary requirement under applicable state law.
11. Relationship to Terms of Service.
This Policy is incorporated into and forms part of the FindMyDirectDoctor
Terms of Service. Your use of the Telehealth Services, including all matters relating to refunds, cancellations, billing, payment disputes, and arbitration of related claims, is governed by the Terms of Service. To the extent of any conflict between this Policy and the Terms of Service, the Terms of Service govern. Any dispute arising from or relating to this Policy is subject to Section 20 of the Terms of Service (Resolution of Disputes and Governing Law).
